New Delhi, November 4, 2025: The Supreme Court has issued notice on pleas challenging provisions of the Rajasthan Prohibition of Unlawful Conversion of Religion Act, 2025.
A Bench of Justices Vikram Nath and Sandeep Mehta directed the Rajasthan Government to respond to the petitions filed by M. Huzaifa and John Dayal, represented by senior advocate Huzefa Ahmadi.
The petitions challenge Sections 5(6), 10(3), 12 and 13 of the Act, which allow administrative authorities to confiscate property, cancel registrations, and order demolitions in cases of alleged unlawful conversions.
The petitioners argued that these provisions violate constitutional rights under Articles 14, 21 and 300A.
It was submitted that empowering officials to order forfeiture or demolition without judicial oversight undermines due process and separation of powers.
The petitioners also stated that the penalties prescribed, including fines up to ₹1 crore and imprisonment up to life for mass conversion, are disproportionate.
They contended that the law legitimizes extrajudicial demolitions, contrary to Supreme Court precedents prohibiting such actions.
